  • 7 Ways to Cancel Escrow (Without Losing Your Earnest Deposit)

    Did you know that once you’re in escrow in Hawaii, you still have multiple protections? Here are 7 ways you can safely cancel the deal and keep your deposit if things don’t line up.

  • 1. J-1 Home Inspection Period

    You have the right to inspect the property. If anything doesn’t sit right—condition, repairs, costs—you can cancel during this period and keep your deposit.

  • 2. Clear Title Requirement

    If the title report reveals liens, ownership disputes, or other defects the seller can’t fix, you can walk away without losing your earnest money.

  • 3. Seller’s Disclosure Review (SRPDS)

    Sellers must disclose known issues with the property. You typically have 10 days to review their disclosure and cancel if something is unacceptable.

  • 4. Condo/HOA Docs

    Buying a condo or property with an association? You’ll get financials, rules, and meeting minutes to review. If you don’t like what you see, you can cancel within the review period.

  • 5. Financing Contingency (Loan Approval)

    If you’re financing and your loan isn’t approved despite a good-faith effort, you can cancel and your deposit is returned.

  • 6. Property Appraisal Contingency

    If the home doesn’t appraise at or above the purchase price and the seller won’t adjust, you can cancel and keep your deposit.

  • 7. Property Condition or Seller Breach

    If the seller fails to keep the property in the same condition, doesn’t complete agreed repairs, or breaches the contract, you can cancel and retain your earnest deposit.
